Privacy Policy For Minors

Note To All Visitors Under 18.  The Decameron Project respects the privacy and rights of children.  All people under the age of 18 who subscribe to our services or make submissions on our Website (“Submissions”) are subject to the following Privacy Policy for Minors (the “Children’s Privacy Policy” or “Policy”), in addition to the terms of our General Privacy Policy.  Our General Privacy Policy is located here: https://decameronproject.org/privacy-policy

I. Privacy Policy For Children 13 To 18 Years Old

 

If you are under 18 years old, or are otherwise unable to form a binding contract, you must have your parent’s or guardian’s permission to use the Services or make any Submissions, and your parent or guardian must provide consent to the terms of this Policy on your behalf.  By using the Services or making any Submission, you represent and warrant that you are not a minor and are of legal age to form a binding contract, or, if the Submission is made by a minor child or children under the legal age of majority (i.e., under 18) (“Children” and each a “Child”), that you are the parent or legal guardian of the Child or Children making a Submission (“Parents” and each a “Parent”), have read and understand the terms of this Policy, the General Privacy Policy and the Terms and Conditions of The Decameron Project, and can legally enter into an agreement with The Decameron Project on behalf of all such minor child/children.

II. Privacy Policy For Children Under 13

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform Parents about our practices for collecting, using, and disclosing personal information from Children under the age of 13.  It also requires us to obtain verifiable consent from a Parent of a Child under the age of 13 for certain collection, use, and disclosure of the child’s personal information.

This section notifies Parents of:

  • The types of information we may collect from Children.
  • How we use the information we collect.
  • Our practices for disclosing that information.
  • Our practices for notifying and obtaining Parents’ consent when we collect personal information from Children, including how a Parent may revoke consent.
  • All operators that collect or maintain information from Children through this Service.

This Section only applies to Children under the age of 13 and supplements the other provisions of this Privacy Policy and the General Privacy Policy.  Only the other provisions of this Privacy Policy apply to persons 13 and older.

A. Information We Collect from Children

Children can access many parts of the Website, Services, and their content and use many of their features without providing us with personal information.  However, some content and features require us to collect certain information, including personal information, from them.  In addition, we use certain technologies, such as cookies, to automatically collect information from our users including Children) when they visit or use the Website or Services.  Consistent with the requirements of COPPA, we will ask for a Parent email address before we collect any personal information from a Child.

We only collect as much information about a Child as is reasonably necessary for the Child to participate in an activity, and we do not condition a Child’s participation on the disclosure of more personal information than is reasonably necessary.

1. Information Collected Directly

For a Child to Use a Service or make a Submission, COPPA requires that we first seek a Parent’s verifiable consent by email.  Therefore, when a Child attempts to use a Service or make a Submission, we will require that the Child provide us with the Child’s first name and their grade, and a Parent’s email address.  We may request additional information from your Child, but this information is optional.  We specify whether information is required or optional when we request it.

We will use this information to contact the Parent and seek Parental consent.  In the email, we will explain what information we are collecting, how we plan to use it, how the Parent can provide consent, and how the Parent can revoke consent.  Parents will be requested to return a signed written form affirming and certifying that that Parent: (i) is the parent or legal guardian of the Child making the Submission; (ii) has reviewed in full and agree to this Privacy Policy, the General Privacy Policy, and the Terms and Conditions in their entirety; (iii) consents to the collection of personal information of their Child as indicated herein; (iv) consents to their Child’s use of any Services and authorize any Submissions to The Decameron Project; and (v) consents, understands and agrees to grant The Project an irrevocable, non-exclusive, royalty-free, sublicensable right and license to have access to, store, display, reproduce, use, modify, broadcast, perform, display, distribute, and exploit the story and any Submissions as it sees fit.   The form is available at the following link: Story Submission.

If we do not receive Parental consent within a reasonable time, we will delete the Submission, Parent contact information, and any other information collected from the Child in connection with their Submission.

2. Information Collected Automatically

We use technology to automatically collect information from our users, including Children, when they access and navigate through the Website or use Services. The information we collect through these technologies may include one or more persistent identifiers that can be used to recognize a user over time and across different websites and online services (e.g., cookies). 

We use the information we collect automatically through technology and other non-personal information we collect to improve our Website and Services.

B. Our Practices for Disclosing Children’s Information

We do not share, sell, rent, or transfer Children’s personal information other than as described in this section.  We may disclose aggregated information about many of our users, including Children.  In addition, we may disclose Children’s personal information:

  • To third parties we use to support The Decameron Project, the Website, Services, or Submissions,  and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential.
  • If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of The Decameron Project or others, including to: (i) protect the safety of a Child; (ii) protect the safety and security of The Decameron Project; (iii) enable us to take precautions against liability; and/or (iv) to law enforcement agencies or for an investigation related to public safety.

C. Accessing, Correcting, or Deleting Your Child’s Personal Information

At any time, Parents can review your Child’s personal information maintained by us, refuse to permit us to collect further personal information from your Children, and/or can request that we delete from our records the personal information we have collected in connection with that Child.  Please keep in mind that a request to delete records may prevent access to Services, including the publication of any Submissions.

Specific Privacy Policy For Submissions Made By Children Under 18

In addition to the other provisions in this Privacy Policy, as well as the General Privacy Policy and the Terms and Conditions for The Decameron Project, additional privacy requirements apply to Submissions.  For Submissions made by Children under 18 years of age, the parent(s) or legal guardian(s) of the Child or Children involved with the Submission must complete the submissions “e-form” available here: Story Submission

On the “e-form,” the Parent must affirm and certify that the Parent: (i) is the parent or legal guardian of the Child making the Submission; (ii) has reviewed in full and agree to this Privacy Policy, the General Privacy Policy, and the Terms and Conditions in their entirety; (iii) consents to the collection of personal information of their Child as indicated herein; (iv) consents to their Child’s use of any Services and authorize any Submissions to The Decameron Project; and (v) consents, understands and agrees to grant The Project an irrevocable, non-exclusive, royalty-free, sublicensable right and license to have access to, store, display, reproduce, use, modify, broadcast, perform, display, distribute, and exploit the story and any Submissions as it sees fit.  For further information regarding Submissions, please see the Terms and Conditions, which are available here: https://decameronproject.org/terms-of-use/.

To the extent that a Submission is made by a Child under 18 without such a written statement, the Submission and any accompanying personal information will be deleted from the records of The Decameron Project within a reasonable time.
